I am writing to you today asking that you support Clause 208 in the upcoming Report Stage of the Crime and Policing Bill, and vote against attempts to remove it from the bill.
Clause 208 would ensure that desperate and vulnerable women in England and Wales are no longer subject to criminal investigation, prosecution, or imprisonment for ending their own pregnancy. The decade-long campaign for this reform is backed by more than 50 organisations, including six medical Royal Colleges, groups working to end violence against women and girls, trades unions, and human rights bodies. The change was strongly supported by MPs from across the House last year, and was added to the bill on a free vote, 379 - 137.
While protecting women, the changes would have no impact on the provision of abortion care:
- There would be no change to the 24-week abortion time limit and in exceptional circumstances beyond;
- Healthcare professionals providing abortion outside the terms of the Abortion Act 1967 would still be governed by the criminal law; and
- Non-consensual abortion would remain a crime at any gestation.
In addition to Clause 208, I ask that you support the amendments 423A and 426B in the names of Baroness Barker and Baroness Thornton, respectively, which were debated at Committee Stage and are essential to protecting vulnerable women from criminalisation. I also urge you to oppose all other abortion-related amendments, which seek to restrict access to lawful abortion in the UK and outlaw telemedical abortion which is essential to women accessing this essential form of healthcare.
I would be grateful if you could confirm whether you intend to support Clause 208 and amendments 423A and 426B from Baroness Barker and Baroness Thornton, respectively, at Report Stage, and commit to not supporting any other abortion-related amendments.
For further information or to receive copies of the briefings from the medical bodies, charities, and women's rights groups that are supporting Clause 208, the BPAS policy team would be happy to assist you at policy@bpas.org.
